Terms of Service

1. Agreement

By creating an account or using vibedropper ("Service"), you agree to these Terms of Service and to our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Use of the Service

You may use the Service for lawful email marketing, list management, and drop-commerce in accordance with these terms and applicable law. You must not use the Service to send spam, collect data without proper consent, or violate any person's rights. You are responsible for obtaining any required consents (including under GDPR or similar laws) from your subscribers before adding them to lists or sending marketing communications.

3. Data protection (GDPR)

When you use the Service to process personal data of your subscribers or customers, you act as the data controller and we act as your data processor. You must ensure you have a lawful basis and, where required, consent for such processing. We process that data only on your documented instructions, and we assist you in meeting your obligations (e.g. responding to data subject requests, security, sub-processors) as set out in our Privacy Policy and in the product (e.g. unsubscribe, consent flags, double opt-in).

4. Account and security

You are responsible for keeping your account credentials secure and for all activity under your account. You may delete your account and associated data at any time from your profile settings. We may suspend or terminate access if you breach these terms or for operational or legal reasons.

5. Intellectual property and licence

We grant you a limited, non-exclusive licence to use the Service for your internal business purposes. You retain ownership of your content and data; you grant us the licence we need to operate the Service (e.g. hosting, sending emails). Our brand, software, and materials remain our property.

6. Limitation of liability

The Service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or profits. Our total liability is limited to the amount you paid us in the twelve months before the claim (or, if no fee, to a reasonable cap). Nothing in these terms excludes liability that cannot be excluded by law.

7. Changes and contact

We may update these terms from time to time; we will notify you of material changes (e.g. by email or in-app notice). Continued use after the effective date constitutes acceptance. For questions: support@vibedropper.com.
